These Terms of Service ("Terms") govern your access to and use of the Rivko mobile application, including all features, content, templates, tools, and services offered within the app (collectively, the "Service"). By downloading, installing, accessing, or using Rivko, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
By accessing or using Rivko, you agree to enter into a binding agreement with the Rivko development team ("we", "us", "our"). These Terms apply to all users, including guest users who access the Service without creating an account, as Rivko is designed to be fully accessible without mandatory account registration. You represent and warrant that you have the legal capacity to enter into these Terms, and if you are using the Service on behalf of an organization, you have the authority to bind that organization to these Terms.

You may access and use the core features of the Service immediately upon download, with no mandatory registration process. While account-free usage is fully supported, we reserve the right to introduce optional account features in future updates, which will be governed by supplementary terms if implemented.
You are solely responsible for maintaining the security of your device, and for all activities that occur on your device while using Rivko. We are not liable for any unauthorized access to your device or your Rivko usage history that results from your failure to secure your device.

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice, if we determine, in our sole discretion, that you have violated these Terms or engaged in conduct that is harmful to other users, the Service, or our reputation.
Rivko offers an optional in-app coin system that allows users to purchase virtual coins to unlock premium features, exclusive templates, advanced customization options, and ad-free usage. All in-app purchases are final and non-refundable, except as required by applicable law. Coins are virtual, non-transferable, and have no monetary value; they cannot be exchanged for cash, gift cards, or any other form of real-world currency.
We reserve the right to adjust the pricing, availability, and terms of in-app purchases and coin usage at any time, with or without notice. You are solely responsible for all charges incurred through your in-app purchases, including any applicable taxes. We are not responsible for any errors or delays in payment processing by your mobile platform provider (Apple App Store, Google Play, etc.).
You retain full ownership of all content that you upload, add, or create within Rivko, including custom wheel options, personal photos, icons, and decision results ("User Content"). By uploading User Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, display, and process your User Content solely for the purpose of providing, maintaining, and improving the Service, including storing your decision history and enabling you to share your result cards.
All intellectual property rights in the Rivko application, including its design, graphics, logos, templates, code, features, and the "Rivko" name and brand, are the exclusive property of the Rivko development team. You may not copy, distribute, modify, or use any of our intellectual property without our prior written consent.
Your privacy is a top priority for us. Our Privacy Policy, available within the Rivko application, governs the collection, use, storage, and protection of your data when using the Service. By using Rivko, you agree to the terms of our Privacy Policy, which is incorporated into these Terms by reference. We do not collect personal information from account-free users beyond the non-identifiable usage data necessary to improve the Service, and we never share your personal data with third parties for marketing purposes without your explicit consent.
Rivko automatically records all your past selections in the "History" tab, allowing you to review your decision history at any time. You are solely responsible for reviewing and managing your history, and for backing up any important decision results that you wish to retain. While we take reasonable measures to secure your history data, we do not guarantee permanent storage of your history, and we are not liable for any loss of history data due to app updates, device changes, or technical issues. We recommend downloading your important results as shareable cards to ensure permanent access.
Rivko is built to put you in full control of your decision-making experience. Whether you're choosing dinner, planning a trip, playing games with friends, or selecting a random winner, you have full freedom to customize your wheels, manage your history, and share your results on your own terms. We are committed to keeping the app fun, intuitive, and secure, so you can focus on letting fate take the wheel, without any hassle.
The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components, or that your use of the Service will meet your expectations.
In no event shall the Rivko development team be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from the Service shall not exceed the total amount you have paid to us for in-app purchases in the 12 months prior to the claim.
We reserve the right to update, modify, or revise these Terms of Service at any time, at our sole discretion. When we make material changes to the Terms, we will notify you by posting the updated Terms within the Rivko application, and the updated Terms will take effect immediately upon posting. Your continued use of the Service after the posting of updated Terms constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically for any changes.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Rivko development team is based, without regard to its conflict of law principles. Any dispute arising from or related to these Terms or your use of the Service shall be resolved through good-faith negotiation first. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in accordance with the rules of the applicable jurisdiction.
